Race Entry Disclaimer.

All participants in racing any SCYC event must comply with the following. Please read this document carefully.

It is the responsibility of the owner/skipper/competitor to ensure that the boat complies with all the clauses contained in this disclaimer.
South Caernarvonshire Yacht Club Ltd. and the Abersoch Keelboat Week organising commitee, shall not be liable for any loss, damage, death or personal injury howsoever caused to the to the owner/skipper or crew, as a result of their taking part in the race or races.
A boat is entirely responsible for her own safety, whether afloat or ashore, and nothing, whether in the Notice of Race or the Sailing Instructions or anywhere else, reduces this responsiblity.
It is for the boat to decide whether it is fit to sail in the conditions in which it finds itself. By launching or going to sea, the boat confirms that it is fit for those conditions and that its crew is competent to sail and compete in them. The boat is required to hold adequate insurance and in particular to hold insurance against third party claims of at least £2,000,000. Nothing done by the organisers can reduce the responsibility of the boat nor will it amke the organisers responsible for any loss, damage, death or personal injury, however it may have occured, as a result of the boat taking part in the racing. (In this context the term 'boat' shall include her owner, sailing master, officers and crew).

The organisers encompass everyone helping to run the race and the event, and include the Organising Authority, the Race Commitee, the Race Officer, patrol boats and their crews and beach masters. The provision of patrol boats does not relieve the boat of her responsibilities.

The Club, Keelboat Week Committee, its Officers, Helpers or Employees shall not be held responsible for any cancellation or change in the Racing Programme caused by inclement weather. The sole arbiter of such conditions shall be the Principal Race Officer.

The Club and Keelboat Week Committee will not accept any liability for any damage to or loss of property belonging to members, their guests of visitors to the Club.

The Club and Keelboat Week Committee will not accept any liability for personal injury arising out of the use of the Clubs' premises and any other facilities of the Club, or out of participation in any race organised by the Club or the Keelboat Week Committee, whether sustained by members, their guests or visitors, whether or not such damage or injury could have been attributed to or was occaisioned by neglect, default or negligence of any of the Offlicers, Committee of Employees of the Club or the Keelboat Week Committee.

In signing the Entry Form helms will agree to the following:-

  1. I have insurance to cover third party for at least £2,000,000.
  2. I have a valid measurement certificate.
  3. I should carry an anchor & at least 60ft of warp during the week.
  4. The safety of a boat and her entire management including insurance shall be the sole responsibility of the owner/person in charge who must ensure that the boat and her crew are adequate to face the conditions that may arise in the course of the race. Neither the "Notice of Race" nor the inspection of the boat limits or reduces the absolute responsibility of the owner/person in charge for the crew the boat and her management. The race organizers shall not be responsible for any loss, damage, death or personal injury howsoever caused to the owner/person in charge, crews & guests as a result of their taking part in the race or races using jetties, ramps, moorings, park premises or any other facility, using or accepting assistance from launches or boats by them, or otherwise however occasioned - whether by negligence of their members or servants or not. Moreover every owner/person in charge warrants the suitability of the boat for the race or races.
  5. If the helm, crew or any person associated with a competing yacht fails in any way to comply with an instruction or request made of them by the Council Beach Patrol or the SCYC Beacmaster and his assistants, that yacht may, at the discretion of the commitee, without a hearing be DISQUALIFIED from the first race or the event or any future events at SCYC.
